The provision for Plea Bargaining in the Indian legal system was introduced through the Criminal Law (Amendment) Act, 2005, which amended the Code of Criminal Procedure, 1973. The provision is contained in Chapter XXI-A of the Code (Section 265A- 265L), which was inserted by the 2005 Amendment. Pursuant to the Malimath Committee Report, the Central Government introduced the Criminal Law (Amendment) Act, 2005. “Plea Bargaining or Mutually Satisfactory Disposition” was introduced then by means of Act No. 2 of 2006 within the Cr.P.C.
