Part VII – Appeals

  1. Appeals from Original Decrees (Section 96 – 99-A)

This part comprises of provisions that give a party, aggrieved from a court’s decree, passed by the court having the original jurisdiction over the matter, a right to appeal against it in an appellate court.

  1. Appeals from Appellate Decrees (Section 100 – 103)

This part comprises of provisions that give a party, aggrieved from a court’s decree, a right to a second appeal generally pertaining to a ‘substantial question of law’, against it in an appellate court.

  1. Appeals from Orders (Section 104 – 106)

This part comprises of provisions of appeal provided by the code but not mentioned under the above two parts. This part also comprises of conditions wherein no appeal shall be entertained.

  1. General Provisions relating to Appeal (Section 107 – 108)

This part comprises of some general provisions in regard to appeal. This part thus is ad hoc to the previously laid down appeal provisions.

  1. Appeals to the Supreme Court (Section 109 – 112)

This part comprises of provisions stating what can be and what cannot be appealled in the Supreme Court.
