PART I – SUITS IN GENERAL

This part of the Code deals with the entire journey of a basic civil suit, starting from the jurisdictional aspects to be considered for institution of a suit, to the decree awarded by the Court after adjudicating the matter.

PART II – EXECUTION

This part of the Code deals with all the provisions regarding the execution of the decree (formal expression of the adjudication of the civil suit) passed by the Court.

PART III – INCIDENTAL PROCEEDINGS

This part of the Code deals with the discretionary power of the Court to appoint a commission for enquiring into some particular facts pertaining to the case for the purpose of imparting complete justice to the parties of the suit.

PART IV – SUITS IN PARTICULAR CASES

This part of the Code deals with specific suits, on as to how can they be instituted and how to proceed with them. The specific suits mentioned in this part are, Suits against State, Suits against Foreign State and an interpleader suit.

PART V – SPECIAL PROCEEDINGS

This part of the Code deals with some specific proceedings. How can those proceedings be initiated and what effect do they have on the original suit that is proceeding in the civil court. The provision for the presently growing ADR mechanism is also in this part of the Code.

PART VI – SUPPLEMENTAL PROCEEDINGS

This part of the Code deals with provisions providing discretionary right to the civil court to conduct some proceedings in the interest of justice. These proceedings will betaken recourse of not as a routine but only in certain exceptional cases, where in the interest of justice, the need for using these provisions arises.

PART VII – APPEALS

This part of the Code deals with provisions providing an aggrieved party to appeal an order, judgement or decree of a court in the appellate court. This provisions lays down guidelines on as to what is appealable and what is not and also what is appealable in what forum.

PART VIII – REFERENCE, REVIEW AND REVISION

This part of the code comprises of provisions that provide remedies apart from appeal, namely, reference, review and revision. Reference can only be used by a court and not any litigant per se, but the other two remedies are available to the litigant.

PART IX – SPECIAL PROVISIONS RELATING TO THE HIGH COURTS NOT BEING THE COURT OF A JUDICIAL COMMISSIONER

This part of the code comprises of provision for the functioning in the High Courts of Court not being of Judicial Commissioner.

PART X – RULES

This part of the code comprises of provisions empowering the High Court to make rules for the better and smooth functioning of the Civil Courts, as it is the High Courts who are believed to be familiar and knowledgable about the procedure governing them and the subordinate Courts.

PART XI – MISCELLANEOUS

This is the last part of the code and comprises of all the sections that are necessary to be a part of the code but did not find a place in any of the parts above. Ranging from exemptions from appearance in court and from arrest, language to be used in the Courts, restitution, caveat, inherent powers of the Court, power to amend defects and to the nature of a court.
